Florida and Massachusetts Shut Down More Compounding Pharmacies

Following on the heels of the state of Massachusetts, where officials announced on Sunday that they had shuttered a third compounding pharmacy for alleged health and safety violations, Florida officials announced on Monday that they have closed down their first compounding pharmacy. According to a report by Reuters, Rejuvi Pharmaceuticals, which is based in Boca Raton, violated "a number" of health regulations.

The news follows a crackdown on the operations of compounding pharmacies across the United States in the wake of the meningitis outbreak caused by tainted injectables that had been compounded by the New England Compounding Center in Massachusetts. The tainted injectables, which contained a particular variety of fungus, have now been linked to more than 354 cases of infection and 25 deaths, according to reports by NBC News and other media outlets.

Here is some of the key information regarding the crackdown on compounding pharmacies that continues around the U.S.

* The FDA released an official statement on Oct. 26 regarding the agency's investigation into the New England Compounding Center (NECC). Among the FDA's findings were several instances where company officials noted the presence of mold and bacteria in the center's "clean room," a situation that remained unaddressed for much of the year. The FDA also noted that the NECC violated regulations pertaining to the dispensing of prescription drugs.

* The FDA announced in its statement that the NECC had been issued a Form 483, which is an official document stating that agency inspectors "believe that they observed conditions or practices" which could point to major health violations.

* The agency did caution in its press release that a Form 483 is not a "final FDA determination," and that its investigation into the meningitis outbreak is ongoing. NECC has been stripped of its license and has shut its doors.

* Massachusetts health officials, who had noted violations by NECC prior to the meningitis outbreak, have cracked down on other compounding pharmacies in the state. The Massachusetts branch of Infusion Resource is the latest compounding pharmacy to be shut down after surprise inspections turned up possible violations, according to a New York Times report on Sunday.

* Massachusetts Gov. Deval Patrick had ordered state health officials to begin conducting unannounced inspections of compounding pharmacies in the state that deal specifically with injectable medications last week, after preliminary reports indicated that state regulations governing such facilities were "insufficient," as quoted by the New York Times.

* According to Monday's report by NBC News, Rejuvi Pharmaceuticals in Florida was shut down by state health officials for multiple violations, which included concerns regarding the "cleanliness of the prescription department" and "the compounding of medications," among other violations.

* Rejuvi had reportedly been cited for the same issues before, and the most recent inspection concluded that the problems had not been addressed after they were brought to the company's attention.

The ETF industry has come a long way from the time when the ETFs were first launched as investment tools to gain exposure to different asset classes. Since then, many ETFs came into existence, of which many could not survive in the industry and had to be shut down. So what could be the possible reason behind those ETFs which were launched only to be shut down later?

Still, the funds that have managed to attract a large amount of assets indicate that they are popular with the investors due to their past performance and expectations for future performance. Investors looking to invest in ETFs with very high AUMs (more than 30 billion) as criteria have the following options available.

SPDR S&P 500 (SPY)

Initiated in January 1993, SPY is the king in the ETF world, with the highest asset under management. It manages an asset base of $118.4 billion. The most popular fund among investors, SPY seeks to invest its heavy asset base in a basket of 500 stocks and trades with an average trading volume of about 135 million shares. The weighting towards the top 10 holdings is also moderate as just 21.4% of the huge asset base goes towards them. This implies that the fund?s asset allocation is not limited to the top 10 holdings but is spread out among other companies as well. ?Apple Inc. (AAPL) takes the top position in the top 10 holdings list with an asset allocation of 4.9%. Among others, the fund does not invest more than 3.3% in any one holding.

Among sector allocation, the fund gives double-digit allocation to the top 5 sectors with information technology being the most preferred sector in the list with an asset allocation of 20.1%.

Vanguard MSCI Emerging Markets ETF (VWO)

This ETF tracks the MSCI Emerging Markets Index in order to provide exposure to a basket of stocks across various developing nations. The product has proven to be extremely popular with investors.

The proof is in the $67.1 billion under management in the fund, while trading volume is more than 18 million shares a day. Also, the cost appears to be minimal at 20 basis points, especially when compared to other emerging market ETFs.

In terms of a portfolio, VWO provides access to 902 securities in its basket and does not allocate more than 3.9% to any one stock. iShares MSCI EAFE Index Fund ETF (EFA)

For investors seeking a broad exposure to developed markets around the world outside of the U.S. and Canada should invest in EFA. EFA tracks the MSCI EAFE Index and provides exposure to companies specifically in Europe, Australia, and the Far East (Seven Biggest International Equity ETFs).

This product manages an asset base of $36.7 billion and is an extremely liquid option available to investors as traded volume on a normal day is more than 14 million. So this product is rich in both AUM and volume.

The fund seeks to invest this asset base in a large basket of 926 stocks and is immune to company specific risk with just 13.4% of assets in the top 10 holdings. Among sector breakdown, the fund is a bit tilted towards financials in which it put in 23.4% of the asset base. Among others the fund does not invest more than 12.3% in any stock.

From a country perspective, United Kingdom takes the top spot at 22.8% of assets, just edging out Japan. The fund charges an expense ratio of 34 basis points on an annual basis.

MSCI Emerging Markets Index Fund (EEM)

The fund managed to build an impressive asset base of $37.4 billion and is also rich in volume trading with volumes of more than 36 million on a normal day. The ETF charges investors 67 basis points in fees for its services. .

It represents a solid pick for long-term investors as it has a well diversified portfolio that doesn?t put more than 3.8% in any one security. Sector exposure, however, is tilted towards financials, information technology, energy and materials where each of them accounts for double-digit allocation.

For countries, China takes the top spot at just about 17% of the total, followed by a 15% allocation to South Korea and a 13% holding in Brazilian firms.

iShares S&P 500 Index Fund (IVV)

Investors seeking for exposure in the large capitalization sector of the U.S. equity market or S&P 500 should look to invest in IVV. IVV trades with an asset base of $32.8 billion.

This produces a product which is home to a large basket of 502 large cap stocks with a spread out holding pattern as it just allocates 21.3% to the top 10 holdings. Apple takes the top spot in the top 10 holdings closely followed by Exxon Mobil and General Electric.

The fund does not appear to be biased towards any particular sector and gives double-digit allocation to almost all the sectors except the last four. The fund also has an edge in expenses as it just charges 9 basis points annually.

Calling hours held for Oneida Mayor

ONEIDA, N.Y. -- People paid their respects to a local leader who passed away. Calling hours were held for Oneida's Mayor on Tuesday.

Don Hudson died after a long battled with an illness, he was 56. Hudson worked for the city for many years, first as a firefighter, and later as a fire chief. He was elected as Mayor in 2011.

Calling hours will continue on Wednesday from 10:00 a.m. until 2:00 p.m. at the Kallet Civic Center. His funeral will be held at the Civic Center following calling hours on Wednesday.

Priorities USA Will Focus on Romney?s Bain Record in Closing Stretch

Priorities USA Action, the chief Democratic super PAC supporting President Obama, will close out the campaign season by reprising a television ad about a man who lost his job as a result of decisions made by Bain Capital while Republican nominee Mitt Romney ran it.

The super PAC ran $20 million in ads throughout the summer to highlight the negative impact of layoffs at companies that were shuttered during Romney?s tenure as head of the venture capital firm. In focus groups with Ohio voters this week, Priorities determined that the most effective ad of the campaign was ?Stage,? in which Mike Earnest talks about building a stage from which company officials announced the termination of his job.

?Turns out that when we built that stage it was like building my own coffin, and it just made me sick,? Earnest says in the ad.

?Participants were able to describe it in detail and recall the emotional impact it had on them, despite the fact that it had not run in that market for over six weeks,? Priorities said in a memo about its closing strategy.

The group will pour millions of dollars into re-running the ad in seven swing states: Colorado, Florida, Iowa, Ohio, Nevada, Virginia and Wisconsin. It will also run a slate of new ads that feature similar personal stories, which will complement a separate $30 million ad buy that seeks to portray Republican policies in a negative light. On top of television advertising, the group is launching what it terms an ?aggressive? online effort to target voters who are more engaged on the Internet than through TV advertising.

?From now until Election Day, we will make sure that voters understand that Mitt Romney?s promise to apply his business experience to Washington would mean policies that benefit the very wealthiest like himself at the expense of middle-class families,? the memo reads. ?The Americans best equipped to share that story are those who have already heard Romney?s broken promises and experienced the devastating impact.?

Independent polling conducted by news organizations over the summer was split on whether the personal attacks against Romney?s record at Bain worked. But Priorities released internal polling in July conducted by a Democratic firm that showed the GOP nominee?s favorability declining in five key battleground states where its ads had run.

Yahoo! Chief Executive Marissa Mayer is taking the struggling company back to its roots in tech and tools.

Marissa Mayer, who earned a reputation for decisive action and intensity during her 13-year stint at Google Inc, has spent her first months as Yahoo Inc CEO quietly moving the Internet pioneer back to its roots in technology.

Long torn between whether it should focus on media content or on tools and technologies, Yahoo under Mayer is being positioned firmly in the latter camp, according to sources inside and outside the company.

Her hires, acquisition musings, and other early moves hint at an ambitious, technology-driven comeback plan designed to revitalize aging but well-trafficked properties such as Yahoo Mail, Yahoo Finance and Yahoo Sports.

Yahoo has been criticized for allowing these sites to stagnate - they look very much like they did five years ago, and do not have many bells and whistles to encourage users to spend more time on them.

Mayer, 37, wants to make Yahoo's properties much more interactive, on PCs and on mobile devices, using social media tools to personalize the user experience and new technology to boost advertising sales. Her well-known focus on user design is expected to result in a simpler, less-cluttered email and home page, one source said.

Yahoo declined to comment for this article. Mayer, who gave birth to her first child weeks ago, will unveil details of her comeback plan when Yahoo reports quarterly results on Monday.

Mayer's focus on technology in many ways reverses a course set by her predecessors, who had concentrated on media content deals, such as those that gave prime billing to Walt Disney Co's ABC News or CNBC, or to bring an original program starring actor Tom Hanks to its website.

The new strategy is not without risks: it positions Yahoo squarely against Facebook Inc and Google. It also risks alienating a large, media-focused contingent that is already weakened by the departure of Ross Levinsohn, who had championed a media-centric approach when he was interim CEO before Mayer's arrival in July.

Mayer has been meeting with Internet gurus including AOL Inc CEO Tim Armstrong, another ex-Googler; Silicon Valley lawyer Larry Sonsini; and Wall Street investment bankers, according to people familiar with the matter.

Bankers have pitched Mayer and her team on a slew of potential acquisitions, and they appeared to show interest in restaurant reservation site OpenTable Inc and advertising technology companies PubMatic, Turn and Millennial Media, one of the people said.

Caterva, a small start-up whose technology analyzes social media activity, has also been in low-level talks with Yahoo, said another source familiar with the situation.

OpenTable and PubMatic declined comment. Millennial Media and Caterva did not respond to requests for comment.

With more than $2 billion in cash and short-term securities, Yahoo has the money to acquire engineering talent or bolt-on services. Two types of deals are under consideration: companies that will increase user engagement, including on mobile, and those that will boost advertising returns, source said.

"What they've signaled so far is that the deals will be more niche in nature, smaller deals that maybe have a lot of promise," said Ken Allen, a director at Blackstone Advisory Partners.

Talent hunt
Many industry insiders believe Mayer is Yahoo's final hope for reversing a years-long decline from the pinnacle it once attained as the leading gateway to the Internet. Four of her predecessors have tried in vain to right the ship - Yahoo's market value of $19 billion, is less than half its $44 billion value in 2005.

Mayer, who earned a masters degree in computer science from Stanford University specializing in artificial intelligence, has moved quickly on the personnel front, shelling out rich pay packages to attract ex-colleagues from Google and elsewhere.

She brought in ad technology systems guru Henrique de Castro as chief operating officer; a new finance chief in Ken Goldman, who also has tech chops, to replace Tim Morse; and Jacqueline Reese to assume the dual role of hiring and acquisitions, suggesting the start of a train of "acqui-hires" or buying small companies for their engineering talent.

"She's spending almost all her time with the product folks. She's spending it on technology. She's talking about engineering hires," a person close to Yahoo said about Mayer's early days.

Yahoo's advertising technology products, headed for the auction block before Mayer's arrival, are back in favor. De Castro, her highest-profile hire, is known for a deep-understanding of the complex advertising landscape, where dozens of businesses and technology providers are interlinked.

Mayer has also shown an interest in the company's ad tech platform, including Right Media, an automated exchange that allows marketers to blast ads across a network of websites.

The group has been a long-standing source of division among Yahoo's management, including with Levinsohn, who was keen on divesting the unit, according to two sources close to the matter. But shortly after Mayer's arrival, Yahoo told AdAge that it had no intention of selling Right Media.

Yahoo's advertising salesforce, responsible for signing splashy home-page ad deals and premium marketing campaigns, has received scant attention from the new CEO, say people close to the company. Michael Barrett, Yahoo's chief revenue officer hired by Levinsohn shortly before Mayer's arrival, recently announced his resignation, according to a source familiar with the matter.

Focus on mobile
Roughly 700 million users visit a Yahoo website every month - putting it in the top ranks globally. But the amount of activity people engage in on many sites is steadily declining, and its smartphone offerings are deemed lackluster.

"The largest change is to be deadly serious about mobile," said a former Yahoo manager who remains in touch with people at the company.

Yahoo faces tough competition from Facebook and Google, two companies that have taken consumers' time, engineering talent and market value from Yahoo. They are also trying to make the transition to mobile, but it has been difficult.

Some say the direction signaled by Mayer is not so different than strategies espoused by previous CEOs that Yahoo has consistently struggled to implement. A fragmented culture in which short-term finances usually trump product plans is to blame, according to those who know the company.

The recent departure of CFO Tim Morse could signal a change in approach, said several former Yahoo employees.

Morse was considered the force behind Chinese e-commerce company Alibaba Group and Yahoo's $7.6 billion deal over the summer, which saw Yahoo sell about half of its 40 percent stake in Alibaba after years of wrangling over terms.

But now Yahoo's Asian partners, including Yahoo Japan Corp, are not on the front burner for Mayer, one source familiar with the situation said.

Whether Wall Street has the patience for yet another Yahoo revival plan remains to be seen.

"Every CEO needs time to have their full vision articulated and understood," said Dan Rosensweig, a former Yahoo chief operating officer, who now serves as CEO of online textbook rental company Chegg.com. "To count Yahoo out would be an enormous mistake, because the users have not counted Yahoo out," he said. "It's not like MySpace, where all the users went away."

Endangered Tattoos: Volunteers Get Inked to Help Save Species [Slide Show]

Mammals, plants, even fungi are emblazoned on humans who fight for their emblem?s survival


Charitable donations to help protect an endangered species are one thing. But would you don a piece of permanent body art to save a mammal, plant or even a fungi? Three years ago, 100 men and women in the U.K.?average people, not scientists?did just that. Each of them went under the needle to get a tattoo of a species they vowed to help protect. A traveling exhibition that lauds these inked advocates will soon come to a close, but the project may spawn broader outreach efforts.

The project, called extInked, was conceived by the Ultimate Holding Company in Manchester, England?a collective of freelance artists who try to use art to spur discussion of uncomfortable social issues. In 2009 the collective worked with conservationists to identify 100 rare and endangered species in Britain, and then brought in artists to ink 100 volunteers in a three-day public marathon. Mammals, amphibians, reptiles, birds, fish, invertebrates, plants and four species of fungi were colored onto the necks, arms, legs and backs of obliging ?ambassadors.?

Since then, the volunteers have given talks at meetings, distributed literature, raised funds with conservation groups, appeared at exhibitions and taken on other activist roles related to their adopted species. ?The ambassadors have brought together the art world, the ecology world, the science world and the tattoo world,? says Kate Houlton, a project manager at Ultimate Holding. ?The project has been a creative way to encourage conversation.? People from as far afield as Canada, Brazil and South Korea have taken up causes after seeing or reading about the tattooed ambassadors, Houlton says.

The exhibition, which features professional photographs of all 100 volunteers and their tattoos as well as information about their species, is making its final stop at the Rugby Art Gallery & Museum in Rugby, England. That show is set to close on November 10, but other galleries are now interested in resuming the tour, Houlton says. Ultimate Holding is also seeking collaborating organizations in other countries that could kick off similar projects.

The extInked project might be inspiring independent efforts, too. One group in California?s Bay Area, called Tatzoo, has held several boot camps to train volunteers to become conservation leaders for local fauna and flora. Graduates receive a certificate and a tattoo of the endangered species of their choice.

First undecided debate questioner undecided no more

Jeremy Epstein, the 20-year-old Long Island college student who asked the first question in Tuesday night?s debate and briefly became a Twitter sensation (hashtag #jeremy), told NBC 4 New York Wednesday that he has decided how he will cast his vote in November.

With the question that set off what would be a testy debate, the junior at Adelphi University sought reassurance about his job prospects after graduation.

Epstein, and exercise science major, said he felt he was speaking for an entire generation with his question.

?I?m representing a whole other group of people my age, people who are facing the exact same problems, who are worried if they?re going to be able to move out of their parents? house and support themselves,? Epstein said, according to Newsday.

?I thought they both spoke very eloquently,? Epstein said, according to NBC 4. ?They both did a great job answering the question.?

Asked Wednesday if he remained undecided, Epstein said he did not.

?No, I think I made a decision,? he said, NBC 4 reports.

Epstein declines to say which candidate he now supports. However, he did tell NBC 4 New York that he had been ?swaying a little bit, I guess, towards the incumbent? before the debate.

If Epstein has decided to vote for Romney, it could be because Romney hammered the theme of job creation in answering Epstein?s question and throughout the rest of the debate.

?We have not made the progress we need to make to put people back to work,? Romney said. ?That?s why I put out a five-point plan that gets America 12 million new jobs in four years and rising take-home pay.?

Romney also promised that his policies would help Epstein.

?I?m going to make sure you get a job,? Romney said.

If Epstein has instead chosen to cast his vote for Obama, it could be because Obama touted the creation of five million private-sector jobs over the last 30 months.

?There are a bunch of things we can do to make sure your future is bright,? Obama said.

Obama also stressed manufacturing jobs in answering Epstein?s question, which Epstein may or may not find appealing once he gets his college diploma.

Epstein told MSNBC?s ?The Daily Rundown? that he was able to chew the fat with both candidates after the debate.

Romney thanked him for his question, according to Epstein?s account of the conversation. The two men then talked about Epstein?s post-college prospects.

?I asked him if he?s gonna give me that job in two years and he said, ?Maybe,?? Epstein said, according to NBC 4.

Epstein said that his conversation with Obama differed substantially. Instead of jobs, the two talked about NBA basketball.

?Then I was speaking with President Obama asking how his Chicago Bulls are gonna do, because they lost their MVP Derek Rose, and he said that I could not beat him in one-on-one, but I disagree with that.?

According to Newsday, Obama suggested that his basketball prowess would be too much for the student.

?I?ve got too many veteran moves for you,? Epstein said the president told him.

How Organised Are You? | Entrepreneur Magazine

It?s difficult to meet your investment goals if you aren?t sure what they are.

Most families try to focus on efficient and effective ways to build wealth and protect it from being eroded by taxes, inflation and market fluctuations.

One of the secrets to a good financial plan should be to concentrate on meeting your personal, predetermined needs and objectives. This task will involve number crunching in relation to the estimation of future interest rates, growth rates, inflation and your current requirements projected into the future.

The goal is to ascertain how much additional capital you will require to provide for this future income requirement. Investors can choose to do nothing, or very little planning, or they can review plans on an
annual basis.

The results will be devastating. Families in this category usually have no control over their financial lives, and regularly find themselves in debt. They will never have any financial security or peace of mind. They will suddenly wake up close to retirement when it is too late to plan their financial future.

Occasional planning

A large section of the investing public fall into this category and they always tend to be one step behind where they could be. This type of investor does not fully appreciate what they are trying to achieve. They make decisions based on once-off investments and, as capital or additional monthly funds become available, they look for a place to invest without considering exactly how this effects other investments already in place.

Not looking at the whole picture usually leads to far too little diversification or a totally unbalanced portfolio. Portfolios could be diversified but with too large a percentage in one asset class.
I was recently consulted by a client who had 26 different policies, retirement annuities and unit trusts.

When I analysed where the money was invested, I discovered that more than 86% was invested in equities. The investor would not even know, because the assets are all invested through various different policies. It is not something that most investors look at in the same way as they do when they have their own segregated portfolio.

Organised investor

The ideal investor is one who identifies and separates needs from wants. The starting point in financial planning is to fully understand what your short?, medium? and long? term requirements are. The following are a few areas that the organised investor has fully considered:

  • Protection for your family in the event of death
  • A plan should you fall ill or become disabled
  • Creation of wealth
  • Saving for a home
  • School and university fees
  • Family celebration (barmitzvah, wedding)
  • Estate planning
  • Retirement planning
  • Tax planning.

Only once you have taken care of your basic needs should you start to plan for all those things that bring pleasure to life. As your circumstances change, so you need to revisit your financial plan. By doing this you will move from the disorganised to the organised. There are a few things I have learnt over the years:

  1. Don?t make any investment decisions unless you know how they fit into your puzzle.
  2. Revisit your whole plan at least once a year.
  3. Keep all your financial records in a safe place and ensure your next of kin know where they are.
  4. Understand the risks associated with each investment.
  5. Know which investments you are hoping to draw income from and which ones are there to provide growth.

Remember, greed and fear must never influence your decision-making. It is the long-term strategy that must determine your investment decisions.

Even professional scientists are compelled to see purpose in nature, psychologists find

ScienceDaily (Oct. 17, 2012) ? A team of researchers in Boston University's Psychology Department has found that, despite years of scientific training, even professional chemists, geologists, and physicists from major universities such as Harvard, MIT, and Yale cannot escape a deep-seated belief that natural phenomena exist for a purpose.

Although purpose-based "teleological" explanations are often found in religion, such as in creationist accounts of Earth's origins, they are generally discredited in science. When physical scientists have time to ruminate about the reasons why natural objects and events occur, they explicitly reject teleological accounts, instead favoring causal, more mechanical explanations. However, the study by lead author Deborah Kelemen, associate professor of psychology, and collaborators Joshua Rottman and Rebecca Seston finds that when scientists are required to think under time pressure, an underlying tendency to find purpose in nature is revealed. The results provide the strongest evidence yet that the human mind has a robust default preference for purpose-based explanation that persists from early in development.

The study is published online in the October edition of the Journal of Experimental Psychology: General (published by the American Psychological Association).

To test the hypothesis that there is a natural preference for teleological explanations, the researchers asked a group of physical scientists from top-ranked American universities to judge explanations such as "Trees produce oxygen so that animals can breathe" or "The Earth has an ozone layer in order to protect it from UV light" under speeded conditions so they had little time to reflect on their answers. Another group of scientists made judgments of the same statements without any time restriction. The researchers found that, despite maintaining high accuracy on control items, scientists who were under time pressure demonstrated greater acceptance of scientifically unwarranted purpose-based explanations than their un-speeded colleagues who generally rejected them. This same pattern of heightened purpose-orientation also held among two control groups -- undergraduates and college graduates from the local community in the same age cohort as the scientists -- although the scientists' overall endorsement of inaccurate purpose-based explanations was lower by comparison. In a second test, the researchers found that despite their years of scientific training, chemists, geologists, and physicists showed no less of a purpose bias than English and history professors whose science knowledge was substantially lower.

"It is quite surprising what these studies show," says Kelemen. "Even though advanced scientific training can reduce acceptance of scientifically inaccurate teleological explanations, it cannot erase a tenacious early-emerging human tendency to find purpose in nature. It seems that our minds may be naturally more geared to religion than science."

Ghent project would build retail, medical office space ...

NORFOLK

A failed project that would have brought new medical office space and a grocery store to Ghent is being revived by another development group that also plans a retail and office project.

The Robinson Development Group and Stanton Partners are in talks with Norfolk officials over city-owned property off 21st Street a block west of Colley Avenue. There is no official deal in place, but Bon Secours spokeswoman Lynne Zultanky confirmed that the health company plans to occupy 26,000 square feet of space there.

Six physicians who are housed in tight quarters across the street at Patient Choice would relocate, and the company would add a new physical therapy service, Zultanky said. In addition to Bon Secours, the development group is working with a large retailer, according to Chris Sanders, a vice president with the Robinson Development Group.

The proposal is for two low-rise buildings, but Sanders said the developers are in "ongoing discussions with the city really about all the details."

A new development plan for the site would strengthen the 21st Street corridor, said Jack Plomgren, president of the Ghent Business Association.

"If that area is developed, I think it will be a real positive for Ghent because right now it's kind of no man's land," he said. "It would expand the reach of Ghent down 21st Street."

But Plomgren said he's also learned over the years to temper his enthusiasm until work actually begins.

Cooper Realty attempted to redevelop the site into a 130,000-square-foot development with a Fresh Market, but the project was halted in 2009 because of decreasing demand for office and retail space. Sanders said Friday that "we certainly believe there is current demand for office and retail at this location."

The Robinson Development Group and Stanton Partners aren't the only ones interested in the land. According to an Oct. 10 letter from S.L. Nusbaum Realty Co., it has offered the city $1 million for the property. The letter, which The Virginian-Pilot obtained from a source familiar with the deal, was sent by Joseph Mersel, the company's senior vice president. Sanders did not say how much his group has offered the city for the land.

Mersel wrote in his letter that he would be willing to build retail and medical offices if the city would sell the land.

According to a copy of an email that the newspaper also obtained, Chuck Rigney, the city's interim economic development director, replied to Mersel that "we are currently working with a developer that has made a proposal with two anchor companies we believe would bring about the highest and best use of the property."

The City Council met in a closed meeting last Tuesday to discuss the "disposition of publicly owned real property on 21st Street," but city spokeswoman Lori Crouch said she could not divulge any information "related to a proposed sale of property or plans while under negotiation."

Fresh Market officials would not confirm that a store is planned for Norfolk. The retailer announces new store leases on its website, where it lists only existing stores in Virginia Beach and Newport News.
